Welcome to YunQi’s services. When you use our services, you trust us with certain information. This Privacy Policy explains how we collect, use, disclose, transfer, and store that information. Please review it carefully and contact us if you have any questions.
By accessing or using our services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with it, please discontinue use of the services.
1. Collection of Information
The information we collect depends on your interactions with us, your privacy choices, and the products and features you use. It may include SDK, API, or JavaScript version; browser and Internet service provider; IP address; platform; timestamps; application identifier and version; distribution channel; device identifiers; advertising identifiers such as IDFA or Android advertising ID; network card address; IMEI where permitted; device model and manufacturer; operating-system version; session start and stop times; language; time zone; and network state such as Wi-Fi connectivity.
Some Service features may allow or require registration through a social-media account, email address, or telephone number. If you use such a feature, we may receive the account details required to provide it, which may include your name, profile image, email address, or telephone number. We collect only the information needed for the relevant feature and subject to your choices and platform permissions.
2. Use of Personal Data
We use personal data to operate, maintain, secure, and improve our services; provide requested features; authenticate users where applicable; respond to support requests; prevent fraud and abuse; comply with legal duties; measure performance; and present advertising where supported by the services.
Where applicable, we aim to provide access to your personal information and a way to correct or delete it, unless retention is required for legitimate business or legal purposes. After information is deleted, residual copies may remain temporarily in active systems or backups as part of routine security and continuity processes.
3. Sharing of Personal Data
YunQi does not share personal information with companies, organizations, or individuals outside YunQi except in the following circumstances:
- With your consent. We may share information when you clearly authorize us to do so. Where required, we obtain opt-in consent before sharing sensitive personal information.
- For external processing. We may provide information to affiliates, vendors, or other trusted parties that process it for us under our instructions, this Privacy Policy, and appropriate confidentiality and security obligations.
- For legal reasons. We may disclose information when we reasonably believe access, use, preservation, or disclosure is necessary to comply with law, regulation, legal process, or an enforceable governmental request; enforce applicable terms; investigate potential violations; detect or prevent fraud, security, or technical issues; or protect the rights, property, or safety of YunQi, our users, or the public.
We may share aggregated or non-personal information publicly or with partners such as publishers, advertisers, analytics providers, or connected services. Vendors and agents working on our behalf may access personal data only as needed to perform their functions and must follow our privacy and security requirements. If YunQi is involved in a merger, acquisition, reorganization, or asset sale, we will continue to protect personal information and provide notice where required before it becomes subject to a different privacy policy.
4. Information Security
We work to protect YunQi and our users against unauthorized access to, alteration of, disclosure of, or destruction of information. Measures may include encryption in transit using SSL or comparable technology, reviews of collection and storage practices, physical and technical safeguards, and access controls that limit personal information to personnel, contractors, and agents who need it to perform their duties and who are subject to confidentiality obligations.
No method of transmission or storage is completely secure. We therefore cannot guarantee absolute security, but we maintain reasonable safeguards appropriate to the nature of the information.
5. International Transfers of Personal Data
Operating the Service may require YunQi or its service providers to process personal data in countries or regions outside your place of residence, including the People’s Republic of China or Singapore. We take appropriate steps designed to ensure that recipients are subject to suitable confidentiality and security obligations and that transfers comply with applicable law.
6. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the policy’s effective date where it is published. Continued use of the services after an updated policy becomes effective means that you acknowledge the current version, to the extent permitted by law. If a material change significantly expands how previously collected personal information may be used or disclosed, we will use reasonable efforts to provide notice and obtain consent where required.
Terms of Service
YunQi develops and/or publishes games for mobile devices (the “Service”). In these Terms of Service (the “Agreement”), “YunQi,” “we,” and “us” refer to YunQi and any authorized publisher of games developed and/or owned by YunQi. “App” refers to any application and related service provided by YunQi.
This Agreement sets out the legally binding terms for your use of any App. By using an App, you accept this Agreement and represent that you have the right, authority, and capacity to enter into it. If you do not agree with all provisions, do not use any App. This Agreement, together with the Privacy Policy above and any feature-specific terms, is the entire agreement between you and YunQi concerning the Apps and supersedes prior agreements regarding the same subject matter.
1. End User License Agreement
1.1 License
Subject to this Agreement, YunQi grants you a limited, non-transferable, non-exclusive, revocable license to download, install, and use the authorized number of copies of each App on devices that you own or control, solely for your personal, non-commercial use and as permitted by the applicable download platform.
1.2 Restrictions
You may not: (a) license, sell, rent, lease, transfer, assign, distribute, host, or commercially exploit the App; (b) modify, translate, adapt, merge, make derivative works of, disassemble, decompile, reverse compile, or reverse engineer any part of the App except where such a restriction is prohibited by law; (c) access the App to build a similar or competitive product or service; (d) copy, reproduce, distribute, republish, download, display, post, or transmit any part of the App except as expressly permitted; or (e) remove or destroy copyright notices or proprietary markings. Future releases, updates, purchases, levels, or gameplay enhancements are subject to this Agreement unless separate terms state otherwise.
1.3 Local Laws
You are responsible for complying with all laws applicable to your use of the App, including export and import regulations.
1.4 Modification of the App
YunQi may modify, suspend, or discontinue any App or any part of it at any time, with or without notice, subject to applicable law. YunQi will not be liable to you or a third party for such modification, suspension, or discontinuance except where liability cannot legally be excluded.
1.5 Ownership
Apps are licensed, not sold. YunQi and its licensors own all rights, title, and interest in the Apps, including related intellectual-property rights, excluding User Content as defined below. The YunQi name, logos, and product names associated with the Apps belong to YunQi or its licensors. No implied license is granted, and all rights not expressly granted are reserved.
1.6 Advertising
The App may display advertising when it starts, stops, or during use, including banner, interstitial, rewarded, or other ad formats. Advertising availability and format may vary by region, platform, age eligibility, consent status, and product configuration.
2. User Content
2.1 Responsibility for User Content
“User Content” means content that a user uploads, distributes, or otherwise provides through the App. You are solely responsible for your User Content and for the risks associated with its accuracy, completeness, usefulness, or disclosure. You represent that your User Content complies with the Acceptable Use Policy below. YunQi is not required to back up User Content, and you are responsible for retaining your own copies.
2.2 License to User Content
When you upload, distribute, or otherwise use User Content through an App, you grant YunQi a non-exclusive, royalty-free, fully paid, worldwide license, with the right to sublicense solely as needed, to host, reproduce, distribute, display, perform, adapt, and otherwise use that User Content to operate, provide, and improve the relevant App features. You represent that you have the rights necessary to grant this license.
2.3 Feedback
If you provide feedback or suggestions, you grant YunQi the right to use them without restriction or compensation. Feedback will be treated as non-confidential unless we separately agree otherwise in writing.
2.4 Acceptable Use Policy
You must not use the App to upload, distribute, or otherwise provide content that infringes third-party rights; is unlawful, defamatory, deceptive, harassing, abusive, threatening, harmful, obscene, or discriminatory; exploits or harms minors; contains unauthorized advertising, spam, chain letters, or pyramid schemes; or violates a law, regulation, or contractual duty.
You must not use the App to distribute malware; collect other users’ information without consent; disable, overload, impair, or interfere with connected servers or networks; attempt unauthorized access; or interfere with another person’s use and enjoyment of the App.
2.5 Enforcement
To the extent permitted by law, YunQi may review, restrict, remove, or modify User Content that violates this Agreement or creates risk for the App, YunQi, users, or third parties. Nothing in this section creates a general obligation to monitor User Content.
3. Term and Termination
This Agreement begins when you first accept it or use an App, whichever occurs first, and remains in effect while you use the App. YunQi may suspend your right to use an App or terminate this Agreement for a legitimate reason, including a material or repeated violation of this Agreement, subject to applicable law.
Upon termination, your license and right to use the App end immediately. Termination may involve deletion of associated User Content from active systems. Provisions that by their nature should survive termination—including ownership, restrictions, User Content licenses already relied upon, disclaimers, liability limits, indemnity, and general terms—will remain effective.
4. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless YunQi and its suppliers from third-party claims, losses, damages, liabilities, costs, and reasonable legal fees arising from your misuse of the App, your User Content, or your material violation of this Agreement. YunQi may assume control of the defense of a covered matter at its expense, and you agree to provide reasonable cooperation. This provision does not apply where prohibited by law.
5. Third Parties
5.1 Application Stores
The App’s availability may depend on a third-party application store. This Agreement is between you and YunQi, not the application store. The store is not responsible for the App, its content, maintenance, support, warranties, or claims relating to it except as required by the store’s own terms or applicable law. You agree to comply with applicable store terms and pay any charges associated with your account.
5.2 Third-Party Services
An App may allow third-party services—such as advertising, analytics, leaderboards, platform services, or game networks—to provide content or functionality. Information may be shared with those services as described in this Privacy Policy and their applicable terms. YunQi does not control third-party services and provides integrations for convenience. You use them subject to their own terms and privacy practices.
5.3 Other Users
The App may contain User Content provided by others. YunQi does not endorse or guarantee that content. Your interactions with other users are between you and those users, and you assume the risks of those interactions to the extent permitted by law.
5.4 Release
To the extent permitted by law, you release YunQi and its suppliers from claims arising solely from interactions with third-party services, other users, or third-party advertisers. If you are a California resident, you waive California Civil Code Section 1542 only to the extent such a waiver is valid and applicable to the release above.
6. Disclaimers
To the maximum extent permitted by law, the Apps are provided “as is” and “as available.” YunQi and its suppliers disclaim express and implied warranties, including merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, and non-infringement. We do not warrant that an App will meet every requirement, remain uninterrupted or error-free, or always be accurate, reliable, complete, legal, secure, or safe. Some jurisdictions do not allow certain exclusions, so some of these terms may not apply to you.
7. Limitation of Liability
To the maximum extent permitted by law, YunQi and its suppliers will not be liable for lost profits or indirect, consequential, exemplary, incidental, special, or punitive damages arising from this Agreement, the App, or YunQi’s privacy practices, even if advised that such damage is possible. You access and use the App at your discretion and risk and are responsible for damage to your device or loss of data resulting from that use.
Where a monetary limit is permitted, YunQi’s total liability for claims arising from the App will not exceed the amount you paid YunQi for the App during the twelve months before the event giving rise to the claim. These limits do not exclude liability that cannot legally be excluded, and local law may provide additional rights.
8. Fees, Purchases, and Subscriptions
You agree to pay fees and applicable taxes incurred through your App account. Payments are processed through the application store from which you obtained the App. If subscriptions are offered, the App will display the subscription period and price before purchase. Payment is charged to your store account at confirmation. Unless otherwise stated or prohibited by law, a subscription renews automatically unless you turn off auto-renewal at least 24 hours before the current period ends. Your store account may be charged for renewal within 24 hours before the end of that period.
You can manage or cancel subscriptions through your application-store settings. Trial periods, if offered, must be cancelled according to the displayed store rules to avoid renewal charges. Prices may change as permitted by store rules and law. Refund eligibility is governed by applicable law and the application store’s policies. Virtual items have no cash value outside the App unless expressly required by law.
9. General
9.1 Changes to This Agreement
YunQi may revise this Agreement from time to time. For material changes, we may provide notice in the App, on an associated website, or by email if available. Changes apply immediately to new users and otherwise become effective as stated in the notice or as permitted by law. Continued use after the effective date constitutes acceptance of the revised Agreement.
9.2 Notices
Notices to YunQi under this Agreement should be sent to 404729090@qq.com.
9.3 Severability
If a provision of this Agreement is held invalid or unenforceable, the remaining provisions will remain effective and the affected provision will be modified to the minimum extent necessary to make it valid and enforceable.
9.4 Entire Agreement and Assignment
This Agreement is the complete agreement between you and YunQi regarding the Apps and supersedes prior discussions and agreements on the same subject. A failure to enforce a provision is not a waiver. Headings are for convenience only. Nothing creates an agency, partnership, employment, or joint-venture relationship. You may not assign this Agreement without YunQi’s prior written consent. YunQi may assign it in connection with a merger, acquisition, reorganization, asset sale, or operation of law.
10. Apple App Store Additional Terms
The following terms apply if you obtain an App through Apple’s App Store. If they conflict with another part of this Agreement, they control solely for use through the Apple App Store.
10.1 Acknowledgement
You and YunQi acknowledge that this Agreement is between you and YunQi, not Apple, and that YunQi—not Apple—is responsible for the App and its content.
10.2 Scope of License
The license is limited to a non-transferable right to use an App on an iOS product that you own or control, as permitted by the usage rules in the App Store Terms of Service.
10.3 Maintenance and Support
YunQi is responsible for maintenance and support services required by this Agreement or applicable law. Apple has no obligation to provide maintenance or support for the App.
10.4 Warranty
YunQi is responsible for App warranties that cannot be disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price where required by its terms. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
10.5 Product Claims
YunQi, not Apple, is responsible for addressing claims concerning the App, including product-liability claims, claims that the App fails to meet a legal or regulatory requirement, and claims under consumer-protection or similar law.
10.6 Intellectual Property Rights
If a third party claims that the App or your use of it infringes intellectual-property rights, YunQi—not Apple—is responsible for investigation, defense, settlement, and discharge of the claim to the extent required by this Agreement or law.
10.7 Legal Compliance
You represent that you are not located in a country subject to a U.S. Government embargo or designated as supporting terrorism, and that you are not listed on a U.S. Government list of prohibited or restricted parties.
10.8 Developer Contact
Questions, complaints, or claims relating to an App may be sent to YunQi using the contact information in Section 9.2.
10.9 Third-Party Terms
You must comply with applicable third-party terms when using the App.
10.10 Third-Party Beneficiary
Apple and its subsidiaries are third-party beneficiaries of these Apple-specific terms and may enforce them against you upon your acceptance of this Agreement.
Your Rights and Options
11. GDPR and Similar Rights
Depending on your location and subject to applicable exceptions, data-protection laws such as the General Data Protection Regulation may give you the following rights:
- Access: request access to personal data we hold about you.
- Rectification: ask us to correct inaccurate or incomplete personal data.
- Erasure: ask us to delete personal data in certain circumstances.
- Restriction: ask us to limit processing in certain circumstances, such as while accuracy is disputed.
- Data portability: receive eligible data in a structured, commonly used, machine-readable format and transmit it to another controller.
- Objection: object to certain processing, including direct marketing and, in some cases, processing based on legitimate interests.
- Automated decisions: request not to be subject to a solely automated decision, including profiling, that produces legal or similarly significant effects, where the right applies.
If processing is based on consent, you may withdraw that consent at any time without affecting the lawfulness of processing that occurred before withdrawal. You may also have the right to complain to your local data-protection authority.
12. Supplemental Notice for United States Residents
We handle personal information in accordance with applicable United States privacy laws, which may include the California Consumer Privacy Act as amended by the California Privacy Rights Act and privacy laws in Virginia, Colorado, Connecticut, Utah, and other states. The exact rights available depend on your state of residence and statutory exceptions.
Where required, we aim to respond to a verified request within 45 days. If more time is reasonably needed, we will notify you of the reason and extension period. If we decline a request, we will explain the basis for that decision and, where applicable, how to appeal.
California
California residents may have the right to know the categories and specific pieces of personal information collected; the categories of sources; the business or commercial purposes for collection, use, sale, or sharing; and the categories of third parties to whom information was disclosed, sold, or shared.
Right to Delete
You may request deletion of personal information collected from you, subject to exceptions. We may retain information where necessary to complete a transaction, provide a requested product or service, perform a contract, protect security, diagnose and repair errors, exercise legal rights, comply with law, conduct eligible public-interest research, or make compatible internal uses allowed by law.
Right to Correct and Access
You may request correction of inaccurate personal information and ask us to confirm whether we process your data. Where applicable, you may request a copy in a portable and, to the extent technically feasible, readily usable format.
Sale, Sharing, and Non-Discrimination
Where applicable law defines certain advertising disclosures as a “sale” or “sharing,” you may have the right to opt out. You also have the right not to receive discriminatory treatment for exercising a privacy right. We may need to verify your identity before completing a request and may ask an authorized agent to provide proof of authority.
